President Cyril Ramaphosa has reaffirmed that he is “not above the law” following a landmark ruling by the Constitutional Court of South Africa directing Parliament to begin an impeachment process into his fitness to remain in office.

The judgment, delivered on Friday, orders the South African Parliament to establish an impeachment committee to investigate whether Ramaphosa is fit to continue serving as president.

The court also set aside the National Assembly’s December 2022 decision in which the governing African National Congress used its majority to block the adoption of a Section 89 independent panel report.

The panel report contained serious findings against the president, stating that he may have breached his oath of office and contravened the Prevention and Combating of Corrupt Activities Act.

Constitutional Court Orders Parliament To Launch Impeachment Inquiry

The Constitutional Court found that Parliament must now establish a formal impeachment committee in line with Section 89 of the Constitution.

The ruling effectively overturns the earlier parliamentary vote that halted the process, reopening scrutiny over allegations linked to the president’s conduct.

The Section 89 panel had previously concluded that there was prima facie evidence suggesting Ramaphosa may have committed serious violations while in office.

Ramaphosa Reaffirms Commitment To Constitution And Rule Of Law

Presidency spokesperson Vincent Magwenya said the president accepts the court’s decision and remains committed to cooperating fully with all legal processes.

“President Cyril Ramaphosa respects the Constitutional Court’s judgment and re-affirms his commitment to the Constitution, the independence of the judiciary and the rule of law.

“President Ramaphosa has been consistent in providing his full assistance to the various inquiries into this matter. President Ramaphosa maintains no person is above the law and any allegations should be subjected to due process without fear, favour or prejudice.”
