The high-profile trial of alleged underworld figure Nafiz Modack descended into fresh disruption on Tuesday, as the presiding judge issued a stark warning to the defence over ongoing delays.
Modack, appearing alongside 14 co-accused in the Western Cape High Court, is facing an extensive list of 122 charges. These include serious allegations such as murder, racketeering, extortion, fraud and money laundering.
Proceedings took a tense turn when the defence sought yet another postponement, prompting a firm response from the bench after a prolonged period of interruptions since the trial began two years ago.
Judge Issues Firm Warning Over Repeated Trial Delays
Advocate Bashier Sibda, representing Modack, told the court he required additional time to secure a further defence witness. The request, however, was met with clear resistance from Judge Robert Henney.
Highlighting the pattern of delays that has characterised the trial, Henney signalled that the court’s tolerance had reached its limit. He instructed the defence to submit a finalised list of witnesses without further delay.
“If not, you close your case, or I’ll close your case for you,” said Henney.

With the court drawing a line under postponements, the defence now faces mounting pressure to proceed without further interruptions.
The matter is set to continue on Wednesday, with expectations that a new witness will be presented.
The warning marks a critical moment in the long-running case, as the court moves to prevent further disruption and bring proceedings closer to conclusion.
