The Judicial Conduct Tribunal, investigating sexual harassment claims against Eastern Cape Judge President Selby Mbenenge, has revealed a significant new development: retired Chief Justice Raymond Zondo may be implicated in the matter.

The Tribunal heard evidence suggesting Zondo’s involvement in handling the complaint that Judges Secretary Andiswa Mengo lodged.

Discrepancies in Mengo’s Complaint Handling

During testimony, Mengo explained that her initial complaint, submitted in December 2022, was “misplaced,” and she was instructed to rewrite it without access to her original submission.

However, Advocate Muzi Sikhakhane SC highlighted a letter from the Secretariat stating that Zondo was “not satisfied” with the first complaint and requested a new one be filed.

In a tense exchange, Sikhakhane questioned Mengo about the discrepancies between the two versions of her complaint, pointing out their striking similarities.

“Do you agree that the complaints are identical?” Sikhakhane asked. Mengo confirmed the similarity but maintained she had no access to the original when writing the second complaint.
