The uMkhonto weSizwe Party (MK Party) has formally approached the National Assembly, urging Speaker Thoko Didiza to begin proceedings that could lead to the removal of Public Protector Kholeka Gcaleka.
The party wants Parliament to invoke Section 194 of the Constitution, which provides a mechanism for the removal of heads of Chapter 9 institutions.
According to MK Party, Gcaleka failed to adequately investigate crucial aspects of the Phala Phala scandal, particularly matters later highlighted in findings by the Independent Police Investigative Directorate (IPID).
MK Party Alleges Serious Omissions In Phala Phala Investigation
The party contends that the Public Protector did not identify or refer possible criminal conduct, misuse of state resources, or irregular actions involving senior police officials.
MK Party said these alleged omissions cast doubt on Gcaleka’s competence and impartiality, arguing that Chapter 9 institutions are expected to operate independently and without favour.
“The Public Protector’s role is to protect the public, and not the politics of a sitting President or politicians,” MKP said.

The request places pressure on Parliament to determine whether there are sufficient grounds to launch a formal inquiry into Gcaleka’s suitability to remain in office.
Should the National Assembly proceed, lawmakers would assess whether the Public Protector is fit to continue serving in one of South Africa’s most important constitutional oversight positions.
