The Johannesburg High Court has ruled in favour of the Democratic Alliance (DA) in its case against the African National Congress (ANC) and its Secretary General, Fikile Mbalula.
The court found the ANC in contempt of court and has ordered the party to hand over its cadre deployment records within 15 days, as per the 2021 ruling by the Constitutional Court.
The DA had approached the court last month, accusing the ANC of withholding records of its cadre deployment committee since 2013. Despite the ANC previously providing limited information, the DA sought legal action to hold the party accountable.

While the Pretoria High Court dismissed the initial application, the DA persisted and approached the Johannesburg High Court on an urgent basis.
The high court agreed with the DA’s claims and condemned the ANC for failing to disclose the records. In addition to ordering the ANC to hand over the records, the court has also instructed the party to cover the legal costs incurred by the DA during the application process.
The DA has welcomed the court’s decision and has urged the ANC to comply with the given time frame. This ruling emphasizes the importance of transparency and accountability within political parties, ensuring that information is readily available to the public and opposition parties.
The ANC now faces the task of fulfilling the court’s order within the specified time frame, further highlighting the significance of adhering to legal obligations and upholding the principles of democracy.
The ruling by the Johannesburg High Court in favour of the DA serves as a reminder that no party is above the law.
