The criminal case against Crime Intelligence boss Lieutenant-General Dumisani Khumalo, Brigadier Dineo Mokwele and their co-accused has been withdrawn after the Investigating Directorate Against Corruption (IDAC) charged them over allegations that have since come under intense scrutiny.

The National Prosecuting Authority (NPA) withdrew the fraud and corruption charges linked to Mokwele’s appointment to a senior Crime Intelligence position, bringing an end to a case that had placed some of the country’s most senior police officials under criminal investigation.

The Pretoria Magistrate’s Court confirmed that the case had been dropped.

“You are free to go,” the court told the accused.

Khumalo and seven other officials were arrested by IDAC in June 2025 as part of the investigation into Mokwele’s appointment.

The prosecution had alleged that Mokwele’s appointment was irregular and that officials had circumvented required processes, including vetting and security-clearance procedures.

The allegations also involved questions about Mokwele’s qualifications and the handling of sensitive intelligence resources.

However, the investigation and the decision to prosecute the officials subsequently came under intense scrutiny during the Madlanga Commission of Inquiry.

The commission heard evidence from senior prosecutors and investigators that raised questions about how the case was assembled and whether investigators had proceeded before sufficient evidence had been gathered.

Senior IDAC prosecutor Advocate Peter Serunye testified that the investigation had proceeded on allegations rather than adequate evidence.

Serunye also told the commission that the case had made little sense to him and that evidence presented during the inquiry had fundamentally changed his understanding of the matter.

Madlanga Commission Examines IDAC Investigation

Former IDAC head Advocate Andrea Johnson has also faced scrutiny over her role in the investigation.

The commission heard allegations concerning pressure within the directorate, as well as disagreements over the strength and direction of the case.

The withdrawal of the charges has added to wider questions about the investigation and the circumstances surrounding the prosecution of Khumalo, Mokwele and their co-accused.

Khumalo’s arrest became particularly significant after KwaZulu-Natal Police Commissioner Lieutenant-General Nhlanhla Mkhwanazi publicly raised allegations involving political interference, organised crime and attempts to disrupt sensitive police investigations.

The Madlanga Commission is examining those broader allegations, including claims involving the Political Killings Task Team and investigations into powerful criminal networks.

The withdrawal of the charges means Khumalo, Mokwele and their co-accused will no longer face prosecution in the case arising from the investigation into Mokwele’s appointment.
